Can you get a patent for something which you bought from somebody who had no intention of patenting it, but could have done so? Do you own the right to patent something which you didn't actually invent, but now own?

Probably the easiest way to avoid any problems down the road is to file the patent application in the name of the inventor and then have the inventor assign the rights to you by means of an assignment documents - and make sure that you record the assignment with the USPTO, assuming, of course, that you are talking about US patent rights.
