transcribing a brand for TM application in the PRC

質問

Hello everybody!

I would like to hear your experiences of registering a trademark in China. I expect that a roman-lettered word mark has to be transcribed into Chinese characters. Which implications does this have for the whole procedure of TM registration? Do I have to register multiple marks?

Thank you very much in advance!

Hi Benjamin
You can register roman-lettered word marks in China - I have never been asked to transcribe them into English prior to filing or even as part of the prosecution process. However, it is a very good idea to separately register the Chinese character version of your mark in China. I have several clients who have found that the Chinese character version of their mark has been registered ahead of them, which can create problems. Also, consider registering your overall logo separately too.
