Concerning data protection: What does it mean for startups that the EU Court of Justice just declared Safe Harbor invalid?

I just read that the EU Court of justice has thrown out the EU-USA Safe Harbor agreement. What are the implications for IT startups on both sides of the Atlantic? How urgent is this? Thanks for quick advice!

It means that you can no longer rely on the EU-US Safe Harbor as a mechanism to legally transfer data from the EU to the US. As of today, the Article 29 Working Party still recognizes Binding Corporate Rules (BCRs) and Model Clauses, but some Data Protection Authorities disagree, depending on which country in the EU we’re talking about. This is a fast moving area with developments unfolding everyday. It is urgent if you transfer personal data from the EU to the US and rely on Safe Harbor to do so.
